Hi cchris,
Just would like to chime in on this topic from my personal experience. I was
originally working for a US company in the US on OPT after finishing my
master degree. My OPT ran out earlier this year and my employer already
petitioned on my behalf for H1B in April. I had got the approval notice a few
weeks ago with a start date in Oct 2007. I'm currently working for the same
employer's foreign subsidary until I can come back to the US on my H1B visa.
My payroll is still being handled by the US, but I am based outside of the US.
We have consulted with the company's immigration lawyer and was told that as
long as I work outside of the US for the company's subsidary legally (I have
a legal work permit for the country I'm currently based in), it does not
matter where I get paid. My current job is a global position, so I wor
closely with both people in the US and in my current region. During the time
I work outside of the US, my income is not US source income and is not
subject to US taxes. My salary is considered cost to the region I'm based and
not the US.
I guess the only difference between my case and the original poster is that
my company posted me to a country where we do have a legal presence and my
current job is not just taking what I was doing in the US to a foreig
soil.
Just want to provide a different perspective on this topic.
