各位先进大家好 想问一个关於112第二段的核驳问题 如果审查委员认为在preamble中的技术特徵没有出现在claim的主文中 就送我一个112第二段的核驳，是不是很奇怪 节录部分文字如下 ...applicant recites limitations in the preamble which do not appear in the body of the claims. The preamble recites the purpose of a processor or the intended use of a structure and when read in the context of the entire claim, recites limitations of the claim, or, if the claim preamble is necessory to give life, meaning, and vatality to the claim, then the claim preamble should be construed as if in the balance of the claim. .....Currently features which appear in the preamble are absent in the body of the claims (e.g., OOXXOOXX ) and no correlation/ and or correspondence of said features which appear in the preamble are found in the body of the claims. Furthermore no circuitry and or connections thereof, as implied by the electrical connection, is noted as being recited. 上述OOXXOOXX是指两个元件之间的连接关系 我觉得奇怪的点在於 1. preamble 如果没有带给 body任何限制的话，不是有可能被认为没有专利权重吗? 诚如审查委员在官文中所述，preamble 说明了这个claim的用途或目的 当preamble的文字对整个claim而言是必要时，解释整个claim时就会 考虑到preamble... 例如 preamble的文字或元件有被引述到claim body中时，此时解释claim时 就无可避免的会考虑到preamble 以本案而言，若preamble的文字没有被引述到claim body，应该可视为没有 专利权重的一段文字吧，有必要发个112的核驳吗? 2. 我目前是倾向於删除OOXX这段话 因为我觉得如果preamble只是要单纯解释claimed invention的用途的话 在preamble里面写两个元件之间的连结关系也颇怪的 说不定审查委员也是觉得这样很怪所以发个112的核驳 以上，我只是想确定一下我的想法，有误的话请用力鞭，谢谢 by the way 另外查到 MPEP 2181 有写到preamble用功能手段用语撰写时 审委用112核驳是合理的 http://www.uspto.gov/web/offices/pac/mpep/s2181.html 还查到 MPEP 2173.05(e)-III 有写到 claim主文引述了preambl所没有的元件时，并不会使整个claim不明确 不过我这次遇到的是preamble的元件连结关系，没有被claim主文引述到 两者相反XD --
