问题:
GATT第24条第5款载明「Accordingly, the provisions of this Agreement
shall not prevent [the formation of customs unions and free-trade areas,
provided that] (a) … the duties [with outside parties] shall not on the
whole be higher or more restrictive than the general incidence of the
duties … prior to the formation …」(简称WTO criterion)。在目前
Customs Unions (CUs)及Free Trade Areas (FTA)的国际浪潮下，为避免被
「边缘化」所遭致的损害，相对於此WTO criterion，有所谓的Kemp-Wan rule
及後来的Krishna and Panagariya (2002)的证明，试申论之。
