已經爬過文，但有些事情還是不太清楚， 想確定一下。 目前狀況： 先生使用OPT（EAD卡今年5/1生效），現在在學校任職，學校最近開始幫忙辦H1b， 但我之前已經買了明年一月回去台灣，二月返美的機票 寫信問學校，得到的答覆如下： 1. If she is going to travel in January and wants to return as an F-2 prior to 5/1/17, DO NOT apply for the H-4 with the H-1B. *Upon return, submit an I-539 for change of status to H4, she is responsible for applying for her H-4. She will have to indicate the request is based on an H-1 application already on file and provide documentation. Since she is requesting a change of status, she will need to remain in the US until a decision is made on her application. It is unlikely her application will be decided at that same time as yours, and could take many months to be adjudicate. 上面這段是說，如果我要這時間回去，我就不要現在跟著一起申請H4， 但是爬文是說一旦H1b遞件，先生的F1也跟著失效，所以我也無法用F2回來美國？ Safest option - Apply for the H-4 now with the H-1B. *She does not leave in January, but waits to travel until H-1/H-4 have been approved. Then apply for H4 visa stamp abroad and enter after 5/1/17. 又說 Once the H-4 application has been submitted and she leave the US, she will not be able to return until after the H-4 is approved sometime next April. If she is out of the country, you can FedEx the approved H-4 to her So that she can reenter the US at that time. 所以我也可以一月離境，但是一路待到5/1在返美？我猜5/1應該是H1b生效日， 那是否可以在生效日前10天入境，即4/21之後就可入境？ （會這樣問是因為機票的三個月效期） 或者在機票不更動的狀態下，拿到H1b的文件後（現在申請二月文件應該下來了吧?!) 去AIT申請H4，但使用ESTA返美，5月再去加拿大換回H4？（會被海關禁止入境嗎？） --
