標題[問題] USPTO的OA

想請問各位前輩
在發明申請案選組過後
日前收到第一次OA
結果在敘明以103核駁的前段文字引敘了一段
"This application currently names joint inventors. In considering
patentability of the claims the examiner presumes that the subject matter of
the various claims was commonly owned at the time any inventions covered
therein were effectively filed absent any evidence to the contrary. Applicant
is advised of the obligation under 37 CFR 1.56 to point out the inventor and
effective filing dates of each claim that was not commonly owned at the time
a later invention was effectively filed in order for the examiner to consider
the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C.
102(a)(2) prior art against the later invention."
這段看了很久似乎無法參透它的意義
覺得平常看核駁論述都沒如此久
後來覺得怪怪的去一查才發現是MPEP的段落
(我對MPEP的文字不知為何都要看很久但似乎又一知半解Orz)
7.20.02.aia Joint Inventors, Common Ownership Presumed
想請問的是
引述這段文字的意義在於
審查委員認為本案的申請人是共同發明人所以建議申請人聲明各請求項在有效申請日並非
共有的嗎???
放完這段範本文字接著就開始講請求項不符合103...etc.
對於這段文字我需要去回應審查委員嗎?
還是他只是建議 ... 說明而已呢?
