It need not be published. : ●存疑 : 就目前來看 唯一能有轉機的是『inventor's certificate』一詞的定義 : 又 MPEP全文檢索沒找到其定義.. 有請版上先進不吝指教 謝謝 小的謝過 完整答覆一下 1. 102(a)已經被克服(無疑義)，除非OA有其他前案 2. 102(b)2012.06公開，未滿一年，被克服，除非OA有其他前案 3. 102(c)無疑義 4. 102(d) bar要成立有四個要件要全部符合 REQ 1: same invention REQ 2: same inventor or his legal representive REQ 3: filed more than 12 months before the eff filing date in US REQ 4: that foreign application is GRANTED 關於102(d)裡面 patented跟inventor's certificate的解釋，在2135.01有詳細敘述 GRANTED指的就是NOA、Issued、核准 就算是台灣的新型無實審，只要領證(或是TIPO發出核准通知)就算 所以本案目前看來是克服了，因為本案"尚未核准"!! 5. 102(e) 等OA看看吧 6. 102(f) ......這是台灣的廠商跟學校最怕的，老師(部門長官)掛名 7. 102(g) 還沒進interference...... --
