標題[問題] U.S.C.102 之適用

[本文有點長 其與U.S.C.102(d)之組成要件相關]
今天某教授打電話給俺問一個案件的案情 大意如下：
案件暫稱 甲案，甲案之發明(A)於95年1月1日完成，未公開。
延至100年1月1日於中華民國提出申請 並於101年6月公開(P)
並於101年8月收到第一次審查意見通知書 美國案尚未申請
教授問： 假設該P為唯一記載(A)之文件 教授是否仍得就該(A)於美國取得專利?
我回答: 是。USC 102(b) 未就早期公開予以排除 故此應適用1年優惠期之條款
後來 總覺得哪怪怪的 翻一下法條 才驚覺自己的回答很有問題
U.S.C. 102(d) 上半段 ●
"the invention was first patented or caused to be patented, or
●
U.S.C. 102(d) 下半段
(the invention) was the subject of an inventor’s certificate...
assigns in a foreign country prior to -the date of the application
for patent in this country- on an application for patent or inventor's
certificate filed more than twelve months before the filing of the
application in the United States
●
發明人在美國以外的國家取得專利或發明人在美國申請日一年前在他國申請專利
即其受U.S.C.102(d)阻卻而喪失新穎性
在絕望之際 看了一下其MPEP之說明 問題就來了

GENERAL REQUIREMENTS OF 35 U.S.C. 102(d)
●所有
35 U.S.C. 102(d) establishes four conditions which, if all are present,
establish a bar against the granting of a patent in this country:
(C) The foreign patent or inventor's certificate must be actually granted
before the U.S. filing date. It need not be published.

就目前來看 唯一能有轉機的是『inventor's certificate』一詞的定義
又 MPEP全文檢索沒找到其定義.. 有請版上先進不吝指教 謝謝 小的謝過
