各位先進好, 日前發生了一件頗令人頭痛的事, 百思不得其解下, 終於還是來版上叨擾, 懇請解惑. -- 關係簡圖: 主機商Dreamhost ======> 我 ========> 侵權行為人W 出租予 復出租予 被侵權人<=不知道要擺哪 事實上侵權行為人是哪一個我也不知道... 我向美國主機商Dreamhost承租一虛擬主機做伺服器之用, 並將其分租予數人, 然日前有一名承租人(以下稱W)因放置影音檔案而遭檢舉, (Berne Convention) 並由主機商Dreamhost來信告知其承租人, 也就是我. 想請教各位: 1. 版權人之損害賠償請求權是直接及於主機商Dreamhost,或是侵權行為人W? (還是我?囧) 2. 轉租人我是否可適用「網路服務免責規定」(ISP safe harbor)? 3. 檔案放置於國外主機, 是否只有增加搜查難度的效果? As Japan and the US are both signatories of the Berne Convention, all copyright laws still pertain the legal distribution of this material.
