各位好, 這是小弟第一次發言, 在爬文和看網路資訊後對簽證申請還是有很多不解, 因此發文想要詢各位問關NIW和J1申請順序的問題. 還希望能得到各位的幫助. 文章較長,有不清楚的地方還請見諒. 我的資料背景如下. 目前在台灣擔任博後 預計年底到美國擔任博後, 聯繫校方預計之後開始處理J1簽證的申請. 而我同時也在準備I-140(NIW)的申請, 已經律師(North America Immigration Law Group) 也有找到願意寫推薦函的老師. 我有跟律師提到我要申請J1, 但他的回覆是 要我先申請I-140再申請J1, 律師說這樣不影響J1的申請, 但據我了解, 在申請J1時會被詢問是否有移民意圖, 我擔心如果我當時已經投出I-140會被拒簽. 所以我有幾個問題想要詢問 1.J1是非移民意圖簽證,如果我在提交J1申請前提交I-140表格是否會影響J1簽證的取得? 2.大部分J1簽證被發放時會受限於212(e) home residency的條款,這似乎取決於金費來源, 如果我的金費並非來自於國家,而來自於私人補助,甚至是我自己的金費, 有沒有可能不受限於212(e) 而得到J1簽證. 3.律師有提到如果我用J1待在美國後再申請I-140, 可能會構成簽證詐欺,被取消身份資格, 但網路上又有許多例子是J1身分下申請I-140的, 律師的說法讓我十分擔憂, 我不知到該先申請I-140或是J1比較好. 4.我目前大概的時程安排如下,希望各位能給我建議. 先申請J1,到美國後請律師申請I-140,我開始自己申請J1的waiver. 不好意思, 問題比較複雜, 我額外把律師的回覆放在下方, 文長請見諒,謝謝您的幫助. 期待您的回覆. 謝謝. a) You should not apply for J1 or enter the US on the J1 visa if you have immigr ant intent as this action is visa fraud which can result in severe immigration p enalties including removal from the US and/or green card revocation. Immigrant i ntent is defined as your mental intent to file the I-485 application. However, i f you will do immigrant visa processing (IVP), then it should be fine to apply f or a J1 visa and enter the US on J1. b) Some J1 visas are subject to 212(e) home residency. If this applies to you, y ou will not be eligible to get a green card unless you either waive the requirem ent or fulfill the requirement by spending two years in your home country. Depen ding on the nature of your J1 program, it may be very difficult or impossible to have the requirement waived. For more information, please contact your program sponsor whether your J1 visa is subject to 212(e) or not. Lastly, 212(e) is not relevant at the I-140 stage. c) Applying for the I-140 NIW should not impact your ability to get a J1 visa. Y our ability to get a J1 visa largely depends on your program sponsor's policies. If they will issue you a J1 visa, then your I-140 application should not impact your ability to get the J1. Your ability to get J1 is also largely dependent on whether or not you can prove that you have non-immigrant intent. For guidance o n how to obtain the J1 visa, we suggest that you contact your university. --
