標題[問題] H1B的 cap gap

最近遇到一個棘手的問題
我目前在美國用opt工作
opt是到今年9/30到期
今年有抽到工作簽證
目前的狀況是在RFE(require for additional evidence)
應該無法在10/1拿到H1B
我想請問一下大家
這樣子的狀況下 10月之後還沒拿到H1B之前
還可以工作嗎???
因為學校說不行但是現在的公司說可以
不知道哪一個說法是對的
也不知道如果不能工作但繼續做的話
會不會有任何法律上的問題
