Legislative Action Necessary
The magnitude of H-1B filings was not fully expected, particularly since
during FY 2007, under somewhat similar economic circumstances, the supply
of numbers lasted eight weeks after the filing period opened and just 90
to 100 cases were denied H-1B numbers after the random selection process
for the final day's receipts was conducted. Though much of the filing
volume can be attributed to increased and pent-up demand, the universal
concern about the quick evaporation of numbers seems to have exacerbated
the filing rush, leading to a self-fulfilling prophecy of sorts that
transformed the opening day of the filing season into the last day of
the season for many.
The fact that volume so greatly exceeded expectations has engendered
renewed calls for speedy congressional intervention. In the next few
days, the firm will be meeting with the American Council on International
Personnel (ACIP), the Compete America Coalition and other allies to
continue efforts to press for legislative relief for FY 2008 and beyond.
Proposed legislation would increase standard cap numbers and create new
cap exemptions. A recently introduced bill would facilitate U.S.
employers' ability to recruit and retain needed talent globally by
increasing the annual limit on H-1B visas from 65,000 to 115,000,
with the flexibility to exceed that limit by 20% in a subsequent year
if the original limit is reached during a given fiscal year. However,
there would be an absolute limit of 180,000 per year. The bill would
exempt from the quota, among others, persons who earn a master's or
higher degree from an accredited institution of higher education in the
United States, as well as those who hold a master's or higher degree
in the fields of science, technology, engineering and mathematics (STEM)
from a foreign institution.
