The forthcoming H-1B and L-1 Visa Reform Act would also increase the government's authority to investigate and audit H-1B and L-1 employers. Though there is no word yet on the timing of the bill, it could be introduced imminently. The text of the bill has not yet been made public, but it is expected to contain the following key provisions, similar to a 2007 H-1B and L-1 bill from the same sponsors: * Labor market test and non-displacement requirements for all H-1B employers. The bill would require all employers seeking to hire H-1B workers to first take good faith steps to recruit qualified U.S. workers. The bill is also expected to prohibit employers from displacing U.S. workers with H-1B workers. * Restrictions on the number of H-1B and L-1 workers in an employer's workforce. The bill would prohibit an employer from hiring additional H-1B and L-1 employees if more than 50% of the employer's workforce is made up of H-1B and L-1 foreign nationals. * Increased government enforcement authority. The bill is expected to broaden the authority of the Department of Labor and the Department of Homeland Security to open H-1B and L-1 investigations and audit employers. The legislation could also contain provisions concerning H-1B and L-1 wage requirements, placement of H-1B and L-1 workers at secondary worksites, and blanket petitions for L-1 workers, in line with the Senators' 2007 bill.
