In 1963一案 Miranda先生被控绑架并强暴一名少女，且在被逮捕後经过讯问而自白犯行 但并没有被告知其有权利保持缄默并聘请律师为其辩护 此案最终上诉至联邦最高法院 法院判决认定Miranda先生的自白因其并未被告知所享有之权利而不得做为证据 我国则在刑事诉讼法第95条有相似之规定 由於执法人员拥有国家赋予之公权力 在以强制力逮捕嫌犯时 一般人民对法律与自己所享有的基本权利几乎不太了解 此基本权利就是宪法所赋予的「缄默权」、「辩护权」等 因此基本的告知义务践行就变得非常有必要 透过这些具体要件的实行 才可以真正达到保障人权的刑事诉讼法制及宪法要求 通常"The Miranda Warning"的内容如下： You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense. 你有权利保持缄默。任何你所说的话将会在法庭上作为呈堂证供。你有权利要求辩护， 并在任何讯问下由律师代表。如果你没有财力足以负担聘请律师的费用，政府将会指派 一位辩护人给你。 以上是米兰达案判决揭示的告知原则--此为简单版 另外比较复杂的版本则会包含所有嫌犯被逮捕或讯问时可能遇到的情况，甚至被逮捕者 会被要求书面签名表示其已了解 You have the right to remain silent and refuse to answer questions. Do you understand? Anything you do say may be used against you in a court of law. Do you understand? You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. Do you understand?
