按W-8Ben状态据以采取不同预扣税，是券商的责任。
如果您的W-8ben过期，但券商没注意还是按外国人身分处理税务，才是错误，
加签这部分只是券商要撇清在您没及时更新W-8BEN期间万一有甚麽责任而已。
至於因W-8过期以致资本利得被券商预扣28% BACKUP WITHHOLDING
券商按法规做事没有任何错误，退款不可能，税金是要上缴IRS的又不是券商自己赚，
但券商有义务於翌年提供1099表格列出预扣明细，透过报税取回预扣税金是绝对没问题的
