What the hell? 简单来说，是50年代，最高法院所发展出来的原则，指出，on active duty的被害人，不能对军医院及其工作人员起诉。当然，这对一个参战的国家是必要 的，一个军医院如果要面对这麽多案件处理，又是deposition又是discovery的，则军 医院就不能真正发挥其效用。 讲这样是没错啦。军医院就是军医院，既然美国在参战状态（之类的），似真是有此 需求。 但是真的公平吗？本案原告是死者唯一的哥哥，死者的死因是军医院医师的医疗过失 致死，医师也承认的确是医疗过失，fact并无争执。现在就是卡在Ferris Doctrine。 所以他到Crane, Pool & Schimdt 求救了。 争执这种最高法院早就表明见解的法律问题，胜率实在是渺茫啊。必须要针对该原则 的适法性(lawfulness)进行攻击。Alan还是跟去second-chair了。 所以说Ferris Doctrine到底问题出在哪。透过这个case，David E. Kelley接着指出， 现在的troops都收一些怎样的人？没错，就是收穷人。他们在贫民区开设服务站，新 进的兵员都来自这里。有什麽办法呢？有钱人为何要冒险自己的生命呢？高智识有大 好前景的人为何要冒险自己的未来呢？在这麽兵源短缺的时代，当然拉不到真正志向 向军事的好兵啊。 这就导向Ferris Doctrine本质上导致不公平的问题啦。这些新兵就是因为穷才去当兵， 现在他们受伤了，甚至死亡了，就因为他on duty，在军医院被医治，malpractice， not a nickel。Not a nickel。所以现在是怎样，人家就是为了钱来，Ferris Doctrine, 就全都挡掉了啊。是哪里公平到了。一点也不公平！ Alan closing 依然精彩。Alan 针对the poor下手： 「事证确凿，医生确定有医疗过失。那这边的discovery是会破坏什麽军事机密？一样 的事情发生在你我的身上，我们可以告到几百万的赔偿金。那Private Canfield呢？ 一毛都没有。这个原则已经不合时宜了。」 「法官，我们的小孩在外浴血奋战哪。But it's not really our kids, is it. it's the poor people's kids.」 It's the poor people's kids. 真是公平。 但这样够吗？这样够去overrule 一个Supreme court ruling吗？ 所以，法官这样ruling， 院: I am allowing the plaintiff's case to stand. 检: Your Honor! The president set by the Ferris Doctrine… 院: The Ferris Doctrine is no longer applicable in today's world. 检: Well then in that case the remedy is the legislator! 院: I disagree, Counselor. This doctrine unfairly victimizes the poor. There are far more rich people registered to vote than poor people. This will never get fixed by an electable legislator.
