网址好读版 goo.gl/UgHFxg 这几天在背包客圈圈里面，最热门的话题就是，澳洲政府放宽了打工度假签证的年龄限制 到35岁，但是这到底是真是假呢? 且看我们下面的分析 一般台湾香港等亚洲国家区的打工度假签证是所谓的417签证。移民法基本上有2部 Migration Regulations 1994跟Migration Act 1992. 因为我们今天不是在上法律课， 所以就不说Act跟Regulations到底有什麽不同等这些细节，简单的说ACT是法案， 在国会三读通过的，Regulation是针对该法案的一些细节补充，2者都是法律。 我们先看一下，旧的移民法(Migration Regulation 1994)对於417签证的年龄规定 417.2--Primary criteria Note: All applicants must satisfy the primary criteria. 417.21--Criteria to be satisfied at time of application 417.211 (1) The applicant satisfies the criteria in subclauses (2), (4) and (5). (2) The applicant: (b) has turned 18 but has not turned 31; and (c) holds a working holiday eligible passport. 其中412.211(2)(b)在旧法中规定，打工度假签证的申请年龄为”未满31岁”。 但是2017/07/01之後有一份Migration Legislation Amendment (2017 Measures No. 3) Regulations 2017 连结在https://www.legislation.gov.au/Details/F2017L00816 你点进去 大概第二页，你会看到 2 Commencement (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms. Commencement information Column 1 Column 2 Column 3 Provisions Commencement Date/Details 1. The whole of this instrument 1 July 2017. 1 July 2017 Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument. 也就是说从01/07/2017开始生效，可是最上面，居然显示 “no longer in force” ‧ - F2017L00816 ‧ No longer in force ‧ View Series 然後你看新的移民法 却又改成了35岁 Migration Regulations 1994 1 Subclause 417.211(2) of Schedule 2 Repeal the subclause, substitute: (2) The applicant: (a) holds a working holiday eligible passport of the kind , or of one of the kinds, specified in a legislative instrument made by the Minister for the purposes of this subclause; and (b) is aged at least 18 and no more than: (i) 35; or (ii) if a younger age is specified in the instrument mentioned in paragraph (a) for the kind of passport the applicant holds—that younger age. 然後你到移民部的网站 http://www.border.gov.au/Trav/Visa-1/417- 上面又说 Age of eligibility – Government announcement The Government is considering options for expanding the upper age of eligibility from 30 to 35 years, including timeframes, legislative requirements and engagement with partner countries. Reciprocity of arrangements for Australian citizens remains a key feature of the programme. The current age of eligibility (18 to 30) will remain in place for the time being. 这到底是怎麽回事呢? 先说一下，这份Migration Legislation Amendment (2017 Measures No. 3) Regulations 2017 是属於” Legislative Instrument”，翻成中文大概就是”法律文件” (以下简称修正案)。这份修正案是移民部做出来的，也通过了”联邦立法登记”。 也就是说这份修正案已经成功注册，完全合法，开始实施的时间是2017年7月1日， 也就是说WHV的年龄要求，在法律层面已经完成修改，移民部其实已经可以按照这份 修正案开始接受新的签证申请，但是为何移民部官方网站上面还是没有开放呢? 原则上虽然这份修正案”目前”是有效的，但是这文件还是得送到参议院跟众议院通过， 才不会有变化，如果说两院之中有任何一方在15个sitting day之内不同意这份修正案， 那麽这份修正案就会被驳回。驳回就是说”不再生效”，但是驳回之前， 这份修正案都是有效的。只是看移民部何时决定要接受签证申请。 所以现在澳洲已经要开始根据这份修正案来审核。法律规定的sitting day 不是工作日， 也不是calendar day, 这个sitting day是指参议院跟众议院开会的日子。如果过了15个 sitting day 他们对於这修正案完全没有意见，那就没问题，移民部就会乖乖依法行事。 但是15个sitting day大概要2-3个月的时间。 移民部到现在还不更正网页，接受申请的最大原因是因为，如果这修正案被驳回， 那这段期间提出申请的签证就会拒签， 所以为了不想要被一般大众投诉，为何你们官网 之前说可以，现在又说不行，移民部基本上会等到此文件确定不会被驳回 才更新网页。 然後那个no longer in force, 只是因为这是个修正案，所以生效之後，当然会自动废止 。那这修正案被驳回的机率高吗? 个人觉得不是很高。 目前比较有可能驳回的修正案是 公民入籍法，主要的症结点是对於IELTS要4个6的要求，(不是平均6喔)。老实说， 背包客来这边奉献自己的青春劳力跟缴税，也有助於澳洲的季节性产业，对澳洲来说 利大於弊，没必要驳回。 我觉得大家现在应该等个2-3个月之後，就可以看到移民部的官方网站的更正了。 先别急，移民部最近已经忙疯了，因为457 ENS RSMS等重大改革，今年财政年度， 移民部还要裁员，所以再给他们一点时间吧。 ┌────────────Aussiekiwi板☆发文注意事项────────────┐ │发表文章前请先详细阅读本板板规 │ │请勿发表无关澳纽生活之文章 │ │若内文过短，请善用推文功能 │ │如果没有问题的话，请按 Ctrl + y 以删除此注意事项。 │ │Then you may start, cheers. :) BY 澳纽板板主│ └─────────────────────────────────────┘ --
